Legal & Consent
Last updated: [date]
This page sets out the terms on which The Elinor Collective provides its services, and constitutes your informed consent to those terms. By booking a Pre-Screen, Clarity Session, Verdict + Plan, or Accountability Layer, you confirm that you have read, understood, and agree to everything set out below. If you do not agree to any part of this page, you should not proceed with booking.
1. Identity of the practitioner
"Elinor" is a professional practice name used by [Melissa Oosthuysen] in the course of providing services through The Elinor Collective. By engaging this service, you acknowledge that you are contracting directly with [Melissa Oosthuysen], and that this identity is disclosed to, and held on file by, our professional indemnity insurer.
2. Description and scope of the service
The Elinor Collective provides structured, paid decision-support services, comprising a Pre-Screen, a live Clarity Session, an optional Verdict + Plan, and an optional Accountability Layer, as further described on the Services page. By booking any of these services, you consent to receiving them on the basis described here and in the accompanying Terms & Conditions.
3. Acknowledgement of what this service is not
You expressly acknowledge and agree that:
This service does not constitute therapy, counselling, psychology, or any other form of mental health treatment;
This service is not a substitute for medical, psychological, legal, or financial advice from an appropriately licensed professional;
No diagnosis of any medical, psychological, or psychiatric condition is made, offered, or implied at any stage of this service;
Where the practitioner considers that your circumstances would be better addressed by a licensed professional, a referral will be provided, and you accept that acting on that referral, and any outcome arising from it, is your sole responsibility.
4. Consent to confidentiality terms
You consent to the collection and confidential treatment of information disclosed in the course of a Pre-Screen or Clarity Session, on the following basis: such information will not be disclosed to any third party without your consent, except where information disclosed indicates a genuine and immediate risk of harm to you or to another person. In that circumstance, you consent in advance to the disclosure of that information to emergency services or another appropriate authority, to the extent reasonably necessary to prevent that harm, without further notice to you being required.
5. Acknowledgement regarding crisis situations
You acknowledge that this service is not a crisis or emergency response service and is not equipped to provide real-time crisis intervention. You acknowledge that if you are in immediate danger, the appropriate response is to contact emergency services on 000, and that Lifeline (13 11 14) and the Suicide Call Back Service (1300 659 467) are available 24 hours a day as alternative sources of immediate support.
6. Consent to location confirmation during sessions
As Clarity Sessions are conducted remotely by phone or video, you consent to confirming your physical location at the commencement of each session, for the sole purpose of enabling an appropriate emergency response should one become necessary.
7. Consent to fees and payment terms
By booking the corresponding service, you acknowledge and consent to the following fee structure:
Pre-Screen ($20): a written review resulting in one of the following outcomes at the practitioner's professional discretion — a referral, a note on readiness, a direct written answer, or an invitation to book a Clarity Session. Where an invitation to book is accepted, this fee is credited toward the Clarity Session fee.
Clarity Session ($55 total; $35 where a Pre-Screen fee has already been credited): a single live consultation of approximately 30 to 45 minutes, the outcome of which is determined at the practitioner's professional discretion.
Verdict + Plan ($100, offered at the practitioner's discretion and accepted at your election): a specific written recommendation, communicated verbally at the conclusion of the relevant Clarity Session and subsequently confirmed in writing.
Accountability Layer ($300 over a 60-day period, optional): a structured program of scheduled check-ins, the terms of which — including treatment of the associated deposit — are disclosed in full at the time of booking and are consented to separately at that time.
8. Acknowledgement that no outcome is guaranteed
You acknowledge that any recommendation, plan, or referral provided under this service reflects the practitioner's professional judgement, formed on the basis of information you have provided, and does not constitute a guarantee of any particular decision, outcome, or result. You accept that responsibility for decisions made and actions taken following this service rests with you.
9. Eligibility and capacity to consent
You confirm that you are 18 years of age or older, and that you have the capacity to provide informed consent to this service on your own behalf. This service is not appropriate for engagement on behalf of a third party, including a minor; if you are seeking support for someone else, you should contact a service equipped to engage with them directly.
10. Complaints and dispute resolution
Any concern regarding this service should be raised in the first instance with [contact email], and will be addressed directly and personally. Where a concern cannot be resolved in this way, it may be raised with [professional indemnity insurer name].
11. Record of consent
Prior to your first paid session, you will be asked to positively confirm — by checkbox, signature, or equivalent means — that you have read, understood, and agree to this page in its entirety, including the confidentiality terms and crisis information set out above. A record of that confirmation, including the date on which it was given, is retained on file for so long as reasonably necessary for professional and insurance purposes.
12. Enquiries
